The Department of Justice is designated for the purposes of section 2(2) of the European Communities Act 1972 (“the 1972 Act”)(1) in relation to the regulation and control of classification, packaging and labelling of dangerous substances and preparations(2), and for measures relating to consumer protection(3).
The Department of Justice, being the Department concerned(4) makes the following Regulations, in exercise of the powers conferred by Section 2(2) of the 1972 Act and Articles 17(1), (2), (3), (4) and (6), 54 and 55(2) of the Health and Safety at Work (Northern Ireland) Order 1978.
In accordance with Article 46(1) of that Order it has consulted with the Health and Safety Executive for Northern Ireland and such bodies as appeared to be appropriate.
1. These Regulations may be cited as the Explosives (Hazard Information and Packaging for Supply) (Amendment) Regulations (Northern Ireland) 2014 and shall come into operation on 1st March 2014.
2. The Explosives (Hazard Information and Packaging for Supply) Regulations (Northern Ireland) 2009(5) are amended as follows—
(a)In paragraph (ii) of the Preamble, for “Regulation (EC) No 689/2008 of the European Parliament and of the Council of 17 June 2008 concerning the export and import of dangerous chemicals be construed as including references to Annexes I and V of that Regulation as those Annexes are amended from time to time” substitute “Regulation (EU) No 649/2012 of the European Parliament and of the Council of 4 July 2012 concerning the export and import of hazardous chemicals(6), of which Annexes I, II, V and VI are as amended from time to time”.
(b)In regulation 3(3)(c), for “Regulation (EC) No 689/2008 of the European Parliament and of the Council of 17 June 2008 concerning the export and import of dangerous chemicals, of which Annexes I and V are as amended from time to time” substitute “Regulation (EU) No 649/2012 of the European Parliament and of the Council of 4 July 2012 concerning the export and import of hazardous chemicals, of which Annexes I, II, V and VI are as amended from time to time”.

These Regulations replace references to Regulation (EC) No. 689/2008 of the European Parliament and of the Council of 17 June 2008 with references to Regulation (EU) No 649/2012 of the European Parliament and of the Council of 4 July 2012.
