The Department of Agriculture and Rural Development being a Department designated for the purposes of section 2(2) of the European Communities Act 1972(1) in relation to the common agricultural policy of the European Union(2), and measures in the veterinary and phytosanitary fields for the protection of public health(3), in exercise of the powers conferred on it by the said section 2(2), makes the following Regulations:-
1.—(1) These Regulations may be cited as the Plant Protection Products (Amendment) Regulations (Northern Ireland) 2012 and come into operation on 29th February 2012.
2. The Plant Protection Products Regulations (Northern Ireland) 2011(4) are amended as follows:
3. In regulation 2(1) (general interpretation) after the definition of “Regulation 1107/2009” insert—
““the Secretary of State” means the Secretary of State for Environment, Food and Rural Affairs :”.
4. Regulation 24(4) shall be deleted.
5. In Schedule 1 (Power of Authorised Persons), paragraph 8(1)(a) and 8(3) for “regulations 8 to 18” substitute “regulation 22”.
6. In Schedule 1 (Power of Authorised Persons), paragraph 8(1)(b) for “unlikely” substitute “likely”.
7. In Schedule 2 (Adjuvants) for “the Department” wherever it appears, substitute “the Secretary of State”.

These Regulations amend the Plant Protection Products Regulations (Northern Ireland) 2011 (the principal Regulations) by a few minor technical amendments.
Regulation 3 amends the Principal Regulations by inserting a definition of “the Secretary of State”.
Regulation 24(4) is deleted as section 8(b) of the Protection of Animals Act 1911 has been repealed.
Schedule 2 is amended to substitute for “the Department”, wherever it appears, “the Secretary of State” as the list of adjuvants will be maintained by the Secretary of State for Environment, Food and Rural Affairs.
