Coming into operation in accordance with Article 1

The Department of Agriculture and Rural Development (1), makes the following Order in exercise of the powers conferred by Article 9(1) of the Horse Racing (Northern Ireland) Order 1990 (2) and with the approval of the Department of Finance and Personnel. In accordance with Article 9(1) of that Order, the Department has consulted with such organisations as appear to it to substantially represent the interests of bookmakers.

Citation and commencement

1.  This Order may be cited as the Horse Racing (Charges on Bookmakers) Order (Northern Ireland) 2010 and shall come into operation on the day after it is affirmed by resolution of the Assembly.

Charges on bookmakers

2.—(1) Subject to paragraph (2) the charges to be paid to the Department under Article 9 of the Horse Racing (Northern Ireland) Order 1990, “the Order”, shall be:

(a)£99 in the case of every person to whom paragraph (1)(a) of that Article applies;

(b)£2,000 in the case of every person to whom paragraph (1)(b) of that Article applies.

(2) The charges to be paid to the Department under Article 9 of the Order for the benefit of the Fund shall be £1,123 in the case of any person to whom paragraph (1)(b) of that Article applies and whose application for the grant or renewal of a licence or for a provisional grant of a licence to be declared final mentioned in that sub-paragraph is made after 31 December 2014.

Revocation

3.  The Horse Racing (Charges on Bookmakers) Order (Northern Ireland) 2007 (3) is hereby revoked.

EXPLANATORY NOTE

(This note is not part of the Order)

Article 9(1) of the Horse Racing (Northern Ireland) Order 1990 provides for charges to be paid to the Department of Agriculture and Rural Development by persons who intend to apply for bookmakers’ and bookmaking office licences.

This Order retains the charges payable by persons, other than those mentioned below, who intend to apply for the grant or renewal of a bookmaker’s licence, at £99.

This Order increases the charges payable by persons who intend to apply for the grant or renewal of a bookmaking office licence or to have the provisional grant of a bookmaking office licence declared final, from £1,123 to £2,000 until 31 December 2014.

After 31 December 2014, charges for off-course bookmaker shops will revert to £1,123.

This Order also revokes the Horse Racing (Charges on Bookmakers) Order (Northern Ireland) 2007.
