The Department of Agriculture and Rural Development(1), in exercise of the powers conferred on it by Articles 3(1), (4) and (6) of the Agriculture (Miscellaneous Provisions) (Northern Ireland) Order 1984(2), and of every other power enabling it in that behalf, after consultation with such organisations, bodies and persons as appear to it to be representative of persons engaged by way of business in the production or marketing of seed potatoes, hereby makes the following Order:
1. This Order may be cited as the Seed Potatoes (Levy) (Amendment) Order (Northern Ireland) 2004 and shall come into operation on 29th March 2004.
2. The Seed Potatoes (Levy) Order (Northern Ireland) 1985(3) shall be amended in accordance with Articles 3 and 4.
3. In Article 2 the definitions of “the Company” and “the Fund” shall be revoked.
4. Articles 6 to 11 shall be revoked.

This Order removes the designation of the former company known as Seed Potato Promotions (Northern Ireland) Ltd as an organisation or body to hold and expend money paid to it by the Department of Agriculture and Rural Development by way of levy, for the benefit, whether direct or indirect, of persons engaged by way of business in the production or marketing of seed potatoes.
