The Department of Health and Social Services, in exercise of the powers conferred on it by Article 1(2) of the Health Services (Primary Care) (Northern Ireland) Order 1997(1) and of all other powers enabling it in that behalf, hereby makes the following Order:

Citation

1.  This Order may be cited as the Health Services (Primary Care) (1997 Order) (Commencement No. 3) Order (Northern Ireland) 1999.

Amendment of the Health Services (Primary Care) (1997 Order) (Commencement No. 2) Order (Northern Ireland) 1998

2.  Article 3 of the Health Services (Primary Care) (1997 Order) (Commencement No. 2) Order (Northern Ireland) 1998(2) shall be amended by the insertion, after paragraph (2), of the following paragraph—

(3) Where section 53(3)(a)(iii) of the Dentists Act 1984(3), as amended by the provisions of Schedule 2 to the 1997 Order, and brought into operation by Schedule 2 to this Order, refers to services under Article 15B of the Health and Personal Social Services (Northern Ireland) Order 1972(4), such a reference is to be taken as referring only to a pilot scheme under Part II of the 1997 Order under which personal dental services are to be provided, and the purpose of bringing that provision of the 1997 Order into operation is limited accordingly..

Explanatory Note

(This note is not part of the Order.)

This Order amends the Health Services (Primary Care) (1997 Order) (Commencement No. 2) Order (Northern Ireland) 1998 (“the Commencement No. 2 Order”) in relation to the bringing into operation, on 1st April 1999, of the amendment to section 53(3)(a)(iii) of the Dentists Act 1984 (“the 1984 Act”) contained in Schedule 2 to the Health Services (Primary Care) (Northern Ireland) Order 1997 (“the 1997 Order”).

The effect of the amendment to the Commencement No. 2 Order is to clarify that references to “national health services” in the 1984 Act include personal dental services provided under pilot schemes under the 1997 Order, and that the commencement of the amendment to section 53 is limited to its application to such pilot schemes (Article 2).
