The Attorney General, in exercise of the powers conferred on him by Article 4(5) of and paragraph 3 of Schedule 1 to the Children’s Evidence (Northern Ireland) Order 1995(1), hereby makes the following regulations:—
1. These Regulations may be cited as the Children’s Evidence (Northern Ireland) Order 1995 (Notice of Transfer) (Amendment) Regulations 1998 and shall come into operation on 14th February 1998.
2. In these Regulations—
“criminal investigation” has the meaning specified in section 1(4) of the 1996 Act;
“the principal regulations” means the Children’s Evidence (Northern Ireland) Order 1995 (Notice of Transfer) Regulations 1996(2);
“the 1996 Act” means the Criminal Procedure and Investigations Act 1996(3).
3. Paragraph 7 of Form 2 in the Schedule to the principal regulations shall cease to have effect in relation to alleged offences into which no criminal investigation has begun before the commencement of Part I of the 1996 Act.

These Regulations revoke paragraph 7 of Form 2 in the Schedule to the Children’s Evidence (Northern Ireland) Order 1995 (Notice of Transfer) Regulations 1996 which informed the accused of the requirement to give notice of particulars of an alibi in accordance with section 1 of the Evidence of Alibi Act (Northern Ireland) 1972. By virtue of regulation 1, the regulations come into operation on 14th February 1998 in relation to alleged offences into which no criminal investigation has begun before 1st January 1998, the date of commencement of Part I of the Criminal Procedure and Investigations Act 1996.
