(This note is not part of the Order.)

This Order provides for the coming into operation of Article 14 of the Industrial Tribunals (Northern Ireland) Order 1996 (“the 1996 Order”) on the day after the Order is made.

Article 14 of the 1996 Order relates to offences for breaching orders made by industrial tribunals restricting publicity in disability discrimination cases, and was contained in section 62 of the Disability Discrimination Act 1995 (c. 50) (“the 1995 Act”) before being consolidated in Article 14 of the 1996 Order. The 1996 Order came into operation on 24th September 1996 repealing Section 62 of the 1995 Act before it had been commenced.

Paragraphs 6(1) and (2) of Part II of Schedule 2 to the 1996 Order have the effect that in these circumstances the 1996 Order has effect with the omission of Article 14 until such day as the Department may appoint by order
