Mae Gweinidogion Cymru, drwy arfer y pŵer a roddwyd iddynt gan baragraff 4 o Atodlen 1 i Ddeddf Iechyd 2006(1), yn gwneud y Rheoliadau a ganlyn:

2006 p. 28. Am ystyr “the appropriate national authority” gweler adran 82(1) o Ddeddf Iechyd 2006 (“Deddf 2006”). Yn rhinwedd adran 162 o Ddeddf Llywodraeth Cymru 2006 (p. 32), a pharagraff 30 o Atodlen 11 iddi, mae swyddogaethau’r “appropriate national authority” o ran Cymru yn arferadwy gan Weinidogion Cymru. Mae Atodlen 1 i Ddeddf 2006 yn gymwys gydag addasiadau i drosedd o dan adran 91 o Ddeddf Plant a Theuluoedd 2014 (“Deddf 2014”) yn rhinwedd adran 91(5) o Ddeddf 2014. Estynnwyd adran 91 o Ddeddf 2014 i gynnwys cynhyrchion nicotin perthnasol gan reoliad 2 o O.S. 2015/895.
