PENNOD 5RHOI CYNLLUNIAU GWEITHREDU AR WAITH

Rhoi cynlluniau gweithredu ar waith

21.—(1) Os bydd cynllun gweithredu neu ddiwygiad o gynllun gweithredu—

(a)wedi'i fabwysiadu yn unol â rheoliad 24; a

(b)yn nodi bod awdurdod cyhoeddus yn gyfrifol am weithred benodol,

rhaid i'r awdurdod cyhoeddus hwnnw drin y cynllun gweithredu fel pe bai'n bolisi iddo i'r graddau y mae'n ymwneud â'r weithred honno.

(2) Caiff awdurdod cyhoeddus wyro oddi wrth unrhyw bolisi a grybwyllir ym mharagraff (1)—

(a)os yw'n darparu ar gyfer—

(i)y Cynulliad, a

(ii)yr awdurdod cymwys sy'n gyfrifol am baratoi'r cynllun gweithredu neu'r diwygiad (os nad y Cynulliad sy'n gyfrifol am hynny),

o roi rhesymau ysgrifenedig am wyro oddi wrth y polisi hwnnw; a

(b)os yw'n cyhoeddi'r rhesymau hynny.

(3) Yn y rheoliad hwn mae “awdurdod cyhoeddus” (“public authority”) yn cynnwys unrhyw berson sy'n arfer swyddogaethau o natur gyhoeddus, ond nid yw'n cynnwys—

(a)Tŷ'r Cyffredin na Thŷ'r Arglwyddi na pherson sy'n arfer swyddogaethau mewn cysylltiad â thrafodion yn y Senedd yn Llundain;

(b)llysoedd na thribiwnlysoedd; nac

(c)y Cynulliad.
