(1)Lle y bydd, yn unol â rheoliadau adeiladu—
(a)hysbysiad yn cael ei roi i awdurdod lleol o gynnig i wneud gwaith adeiladu y mae'r Mesur hwn yn gymwys iddo, neu
(b)cynlluniau llawn o waith o'r fath yn cael eu hadneuo gydag awdurdod lleol,
rhaid i hysbysiad neu gynlluniau o'r fath gynnwys y cyfryw wybodaeth ag sy'n ofynnol o dan is-adran (2) neu rhaid i wybodaeth o'r fath fynd gydag ef, a rhaid cynnwys y cyfryw ffi a ragnodir.
(2)Yr wybodaeth sy'n ofynnol gan yr is-adran hon yw'r cyfryw wybodaeth, at ddibenion dangos bod modd i'r gwaith, unwaith y caiff ei gwblhau, gydymffurfio â gofynion adran 1(4), ac sydd, boed mewn perthynas â ffurf neu â chynnwys, wedi'i rhagnodi.
(3)Os, ar ôl rhoi hysbysiad o'r fath neu adneuo cynlluniau o'r fath, nad yw'r wybodaeth sy'n ofynnol gan is-adran (2)—
(a)yn gyflawn ym marn yr awdurdod lleol, neu
(b)yn dangos bod modd i'r gwaith, unwaith y caiff ei gwblhau, gydymffurfio â gofynion is-adran 1(4) ym marn yr awdurdod lleol,
rhaid i'r awdurdod, o fewn y cyfnod perthnasol, roi hysbysiad yn ysgrifenedig o'r farn honno i'r person a roddodd yr hysbysiad hwnnw neu, yn ôl y digwydd, y person a adneuodd y cynlluniau hynny, gan nodi'r rhesymau dros y farn honno.
(4)Caiff person sydd wedi cael hysbysiad o dan is-adran (3) ddiwygio'r wybodaeth y mae'r hysbysiad yn perthyn iddi a'i chyflwyno i'r awdurdod lleol, ac, yn yr achos hwnnw, ni fydd grym i'r hysbysiad a roddir o dan is-adran (3), ac, yn ddarostyngedig i is-adran (5), bydd is-adrannau (2) a (3) yn gymwys mewn perthynas â'r wybodaeth honno fel pe bai wedi'i chynnwys yn yr hysbysiad neu'r cynlluniau y cyfeirir atynt yn is-adran (1) neu fel pe bai wedi mynd gyda hwy.
(5)Os caiff gwybodaeth ddiwygiedig ei chyflwyno o dan is-adran (4), bydd y cyfnod perthnasol y cyfeirir ato yn is-adran (3) yn mynd o'r dyddiad y cafodd yr awdurdod lleol yr wybodaeth.
(6)At ddibenion y Mesur hwn, ystyr “y cyfnod perthnasol” (“the relevant period”) yw pum wythnos neu'r cyfryw gyfnod estynedig sy'n dod i derfyn heb fod yn hwyrach na deufis ar ôl—
(a)rhoi'r hysbysiad neu adneuo'r cynlluniau, neu
(b)pan fydd is-adran (4) yn gymwys, y dyddiad y cafodd yr awdurdod lleol yr wybodaeth,
ag a gytunir yn ysgrifenedig cyn diwedd y pum wythnos ar y cyd â'r awdurdod lleol a'r person sy'n rhoi'r cyfryw hysbysiad neu'n adneuo'r cyfryw gynlluniau.
(7)Mewn unrhyw achos pan fydd cwestiwn yn codi ynghylch cywirdeb barn awdurdod lleol y seiliwyd hysbysiad a roddwyd o dan is-adran (3) arni, caiff y person y cafodd y cyfryw hysbysiad ei roi iddo gyfeirio'r mater at Weinidogion Cymru i'w benderfynu a chaiff Gweinidogion Cymru ddiddymu, addasu neu gadarnhau'r hysbysiad.
(8)Rhaid i'r ffi a ragnodir fynd gydag unrhyw gyfeiriad at Weinidogion Cymru o dan is-adran (7).
