The Welsh Ministers in exercise of the powers conferred on the Secretary of State by sections 408 and 569(4) and (5) of the Education Act 1996(1) and now vested in them(2), and after consulting with those persons with whom consultation appeared to the Welsh Ministers to be desirable pursuant to section 408(5) of the Education Act 1996, make the following Regulations:

Title, commencement and applicationE+W

1.—(1) The title of these Regulations is the Head Teacher’s Report to Parents and Adult Pupils (Wales) (Amendment) Regulations 2014 and they come into force on 1 September 2014.

(2) These Regulations apply in relation to Wales.

Amendment to the Head Teacher’s Report to Parents and Adult Pupils (Wales) Regulations 2011E+W

2.—(1) The Head Teacher’s Report to Parents and Adult Pupils (Wales) Regulations 2011(3) are amended as follows.

(2) In regulation 2 in the appropriate place in the alphabetical order insert—

“Educational Programmes and Programmes of Study Order 2013” (“GorchymynRhaglenniAddysgol a RhaglenniAstudio 2013”) means the National Curriculum (Educational Programmes for the Foundation Phase and Programmes of Study for the Second and Third Key Stages) (Wales) Order 2013(4).

(3) In regulation 3 for paragraph (3) substitute—

(3) The report must contain the information about the educational achievements of the pupil or adult pupil to whom or to whose parent the report is made available and the information relating to that pupil set out in—

(a)paragraph 1 of Part 1 of the Schedule where that pupil is in the foundation phase, the second key stage or the third key stage;

(b)paragraphs 2, 3 and 4 of Part 1 of the Schedule and Part 2 of the Schedule, where that pupil is in the second, third or fourth key stages;

(c)Part 3 of the Schedule, where that pupil was entered for any approved relevant qualifications at NQF level 3 or above; and

(d)Part 4 of the Schedule.

(4) In regulation 4 omit paragraph (4).

(5) After regulation 4 insert—

End of foundation phase and end of second and third key stage information

4A.  The report must contain the information in Part 5 of the Schedule where the pupil is in the final year of the—

(a)foundation phase;

(b)second key stage; or

(c)third key stage.

(6) In the Schedule—

(a)for paragraph 1 of Part 1substitute—

Pupils in the foundation phase and the second and third key stages

1.(1) The results of any assessment carried out in accordance with the assessment arrangements specified by the Welsh Ministers in the Education (National Curriculum) (Assessment Arrangements for Reading and Numeracy) (Wales) Order 2013.

(2) A brief summary of the pupil’s progress in relation to the additional educational programmes and additional programmes of study given legal effect to by the Educational Programmes and Programmes of Study Order 2013.;

(b)omit Part 4A and Part 4B; and

(c)after Part 4 insert—

Part 5E+W

Pupils at the end of the foundation phase

8.(1) In relation to each relevant area of learning a brief description of each foundation phase outcome attained by the pupil in each of those relevant areas of learning in the final year of the foundation phase.

(2) In relation to all other areas of learning a brief statement of the level of attainment achieved by the pupil in each of those areas of learning in the final year of the foundation phase.

(3) A brief statement of the pupil’s progress during the period the pupil was in the foundation phase in relation to the educational programmes given legal effect by Part 1 of the Educational Programmes and Programmes of Study Order 2013.

Pupils at the end of the second and third key stages

9.(1) A brief statement of the pupil’s progress during the period the pupil was in the second key stage in relation to the educational programmes given legal effect by Part 1 of the Educational Programmes and Programmes of Study Order 2013.

(2) A brief statement of the pupil’s progress during the period the pupil was in the third key stage in relation to the educational programmes given legal effect by Part 1 of the Educational Programmes and Programmes of Study Order 2013..

EXPLANATORY NOTE

(This note is not part of the Regulations)

The Head Teacher’s Report to Parents and Adult Pupils (Wales) (Amendment) Regulations 2014 (“the 2014 Regulations”) amend the Head Teacher’s Report to Parents and Adult Pupils (Wales) Regulations 2011. The 2014 Regulations make provision as to the report the head teacher is required to send to parents and adult pupils each school year, at the end of the foundation phase and the second and third key stages and the additional information parents of registered pupils who are assessed in any key stage may request.

These Regulations amend the 2014 Regulations by—

(a)inserting a new definition of “Educational Programmes and Programmes of Study Order 2013” (regulation 2(2));

(b)inserting a new regulation 3(3) which sets out which of the information in the Schedule to the 2014 Regulations must be included in the head teacher’s report to parents and adult pupils each school year (regulation 2(3) and (6)(a));

(c)omitting regulation 4(4) and inserting a new regulation 4A. Regulation 4A and Part 5 of the 2014 Regulations sets out the information which must be included in the head teacher’s report to parents and adult pupils when the pupil is in the final year of the foundation phase, or the second or third key stages (regulation 2(4) and (5). Part 5 is inserted by regulation 2(6)(c)); and

(d)omitting Parts 4A and 4B and re-enacting them as a new paragraph 1(1) and (2) in Part 1 (regulation 2(6)(a) and (b)).

The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations. As a result, it was not considered necessary to carry out a regulatory impact assessment as to the likely costs and benefits of complying with these Regulations.

The functions of the Secretary of State under these sections were transferred to the National Assembly for Wales by the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672) and then to the Welsh Ministers under section 162 of, and paragraph 30 of Schedule 11 to the Government of Wales Act 2006 (c. 32).
