Under section 55(2) of the Local Government Act 1972 (“the 1972 Act”) a county or county borough council in Wales may make recommendations to the Local Government Boundary Commission for Wales (“the Commission”) in relation to the abolition or alteration of communities in their area. The Commission may, in consequence, make to the National Assembly for Wales such proposals as appear desirable in the interests of effective and convenient local government in accordance with sections 54(1) and 58(1) of the 1972 Act. The National Assembly for Wales may give effect to any such proposals under section 58(2) of the 1972 Act.
Bridgend County Borough Council made recommendations to the Commission in respect of the Community of Cynffig in their area. The Commission in turn made recommendations to the National Assembly for Wales in March 2001 to which effect is given by this Order.
Article 3 abolishes the community of Cynffig and creates two new communities called Cornelly and Pyle which are shown on the boundary map marked “Map of the Bridgend (Cynffig, Cornelly and Pyle Communities)(Electoral Changes) Order 2002” which is deposited at the offices of Bridgend County Borough Council, Civic Offices, Angel Street, Bridgend and at the National Assembly for Wales, Cathays Park, Cardiff (Local Government Division) and is open for inspection during normal office hours.
Article 4 provides for the elections for the two new community councils to be held on 2nd May 2002. Newly elected councillors shall take office on 6th May 2002 and retire on the fourth day after the ordinary election of councillors in 2004. Members of the existing Cynffig community council shall retire on 2nd May 2002.
The expenses of the two new community councils of Cornelly and Pyle are dealt with in Article 5 whilst Article 6 specifies both communities for the purposes of regulation 41(4) of the Local Government Area Changes Regulations 1976 (Local Acts, Orders and byelaws).
Article 7, by reference to the Schedule, addresses the transfer of certain specified property matters from Cynffig community council to the two new community councils.
