This Order brings into force on 5th February 2004, in the United Kingdom and Gibraltar, the provisions of the European Parliament (Representation) Act 2003 relating to returning officers and disqualification from office of MEP so far as they have not already been brought into force by the earlier commencement orders mentioned below. It also brings into force section 19 for most remaining purposes (which provision extends to Gibraltar the European Parliamentary Elections Act 2002) except in respect of provisions concerning the entitlement to vote and reviews as to the distribution of MEPs amongst the electoral regions.

It brings into force for Gibraltar section 28(2) (which extends the Act to the United Kingdom and Gibraltar) so far as it relates to the above mentioned provisions. It also brings into force in Gibraltar sections 1 and 8, which relate to the number of MEPs and electoral regions.
