The Secretary of State for Health, in exercise of the powers conferred on him by section 79A of, and paragraph 3(2) and 3(3) of Schedule 12 to, the National Health Service Act 1977(1) and of all other powers enabling him in that behalf, hereby makes the following Regulations–
1.—(1) These Regulations may be cited as the National Health Service (Dental Charges) Amendment Regulations 2000 and shall come into force on 1st April 2000.
(2) These Regulations extend only to England.
2. In regulation 4 of the National Health Service (Dental Charges) Regulations 1989(2) (calculation of charges), in paragraph (5), for “£348 ” in both places where it occurs there shall be substituted “£354 ”.
3. The National Health Service (Dental Charges) Amendment Regulations 1999(3) are hereby revoked.
4. Where, on or after 1st April 2000, appliances are supplied, or other general dental services are provided, in pursuance of a contract or arrangement for the provision of general dental services made before that date, regulation 4(5) of the National Health Service (Dental Charges) Regulations 1989 shall have effect in respect of that supply or other provision as if these Regulations had not come into force.

These Regulations further amend the National Health Service (Dental Charges) Regulations 1989 to increase from £348 to £354 the maximum charge payable by the patient for dental treatment and appliances, where the contract or arrangement leading to the provision of such treatment or appliances is made on or after 1st April 2000.
1977 c. 49; see section 128(1) as amended by the National Health Service and Community Care Act 1990 (c. 19), section 26(2)(g) and (i), for the definitions of “prescribed” and “regulations”. Section 79A was inserted by the Health and Medicines Act 1988 (c. 49), section 11(3). The functions of the Secretary of State under the National Health Service Act 1977 are, so far as exercisable in relation to Wales, transferred to the National Assembly for Wales by article 2(a) of the National Assembly for Wales (Transfer of Functions) Order 1999, S.I. 1999/672 as amended by section 66(5) of the Health Act 1999 (c. 8).
