The Secretary of State for Health, in exercise of powers conferred on him by section 92(1) of the National Health Service Act 1977(1) and of all other powers enabling him in that behalf, having regard to the change in the arrangements for the administration of hospitals and other establishments and facilities previously managed by the former Bexley Health Authority resulting from the establishment of the Bexley Community Health National Health Service Trust (now known as the Oxleas National Health Service Trust)(2), having consulted the former Bexley and Greenwich Health Authority(3) and that Trust in accordance with section 92(3) of that Act, hereby makes the following Order:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Oxleas National Health Service Trust (Transfer of Trust Property) Order 1997, and shall come into force on 12th February 1997.

(2) In this Order —

“the Authority” means the Bexley and Greenwich Health Authority established on 1st April 1996(4);

“the old Authority” means the Bexley and Greenwich Health Authority established on 1st April 1994(5) and abolished on 1st April 1996(6);

“the Trust” means the Oxleas National Health Service Trust;

“the trust property” means the items specified in a schedule of trust property prepared by and agreed upon by the old Authority and the Trust on 30th June 1995, which schedule has been signed on behalf of both the old Authority and the Trust.

Transfer of trust property

2.  On 12th February 1997 the trust property shall be transferred from the Authority to the Trust.

Explanatory Note

(This note is not part of the Order)

This Order transfers to the Oxleas Community Health National Health Service Trust on 12th February 1997 trust property held by the Bexley and Greenwich Health Authority. A copy of the schedule of trust property to which the Order refers can be obtained from the Department of Health, NHS Trust Unit, Room 1W29, Quarry House, Quarry Hill, Leeds LS2 7UE.
