Defnyddir y term darpariaeth i ddisgrifio elfen ddiffiniadwy mewn darn o ddeddfwriaeth sy'n cael effaith ddeddfwriaethol – megis Rhan, Pennod neu adran. Mae fersiwn o ddarpariaeth yn rhagolygol naill ai:

  1. os nad yw'r ddarpariaeth (Rhan, Pennod neu adran) erioed wedi dod i rym neu;
  2. pan fo testun y ddarpariaeth wedi'i newid, ond nad oes dyddiad wedi'i bennu eto gan y person neu'r corff priodol i'r newidiadau hynny i ddod i rym.

Gall Gorchmynion Cychwyn a restrir yn y blwch 'Newidiadau i Ddeddfwriaeth' fel rhai sydd heb eu gwneud eto ddod â'r fersiwn ragolygol hon i rym.

Changes to Legislation

Efallai na fydd deddfwriaeth ddiwygiedig sydd ar y safle hwn yn gwbl gyfoes. (1)Rhaid i’r prif berson atebol ar gyfer adeilad categori 1 cofrestredig neu adeilad categori 2 cofrestredig, o fewn y cyfnod cadarnhau, roi i awdurdod diogelwch adeiladau yr adeilad ddeclarasiwn perthnasol.

(2)Mae “declarasiwn perthnasol” yn ddeclarasiwn ynghylch cywirdeb yr wybodaeth a’r dogfennau a gynhwysir yn y cofnod ar gyfer yr adeilad yng nghofrestr yr awdurdod sy’n cydymffurfio â rheoliadau a wneir o dan is-adran (3).

(3)Rhaid i Weinidogio‍n Cymru, drwy reoliadau, wneud darpariaeth ynghylch—

(a)ffurf a chynnwys declarasiwn perthnasol;

(b)sut y mae rhaid rhoi declarasiwn perthnasol.

(4)Nid yw is-adran (1) yn gymwys—

(a)os yw’r awdurdod diogelwch adeiladau wedi rhoi hysbysiad i’r prif berson atebol o benderfyniad i ddileu’r adeilad o’r gofrestr o dan adran 26(6), a

(b)naill ai—

(i)nad yw’r dyddiad y mae’r penderfyniad hwnnw yn cymryd effaith wedi ei gyrraedd eto, neu

(ii)nad yw’r penderfyniad wedi cymryd effaith eto yn rhinwedd adran 26(9) (atal dros dro wrth aros am adolygiad neu apêl).

(5)Mae is-adran (6) yn gymwys os yw adran 26(9) yn peidio â bod yn gymwys yn rhinwedd bod y penderfyniad i ddileu’r adeilad o’r gofrestr yn cael ei ganslo neu ei ddiddymu—

(a)yn ystod yr 14 o ddiwrnodau olaf y cyfnod cadarnhau, neu

(b)ar ôl diwedd y cyfnod cadarnhau.

(6)Rhaid i’r prif berson atebol roi declarasiwn perthnasol i’r awdurdod diogelwch adeiladau cyn diwedd 14 o ddiwrnodau sy’n dechrau â’r diwrnod drannoeth y diwrnod y caiff y penderfyniad ei ganslo neu ei ddiddymu.

(7)Cyn diwedd 21 o ddiwrnodau sy’n dechrau â’r diwrnod drannoeth y diwrnod y rhoddir y declarasiwn perthnasol, rhaid i’r awdurdod diogelwch adeiladau hysbysu’n ysgrifenedig y prif berson atebol ei fod wedi cael y declarasiwn.

(8)Mae prif berson atebol yn cyflawni trosedd os yw’r person yn methu heb esgus rhesymol â rhoi declarasiwn perthnasol i awdurdod diogelwch adeiladau yn unol ag is-adran (1) neu (6) (fel y bo’n gymwys).

(9)Mae person sy’n euog o drosedd o dan is-adran (8) yn agored—

(a)ar euogfarn ddiannod, i ddirwy neu i’w garcharu am gyfnod nad yw’n hwy na’r terfyn cymwys o dan adran 224(1A)(b) o’r Cod Dedfrydu, neu’r ddau;

(b)ar euogfarn ar dditiad, i ddirwy neu i’w garcharu am gyfnod nad yw’n hwy na 2 flynedd, neu’r ddau.

(10)Mae person sydd wedi ei euogfarnu o drosedd o dan is-adran (8) yn cyflawni trosedd bellach os yw’r person yn parhau i fethu â rhoi declarasiwn perthnasol i’r awdurdod diogelwch adeiladau.

(11)Mae person sy’n euog o drosedd o dan is-adran (10) yn agored ar euogfarn ddiannod i ddirwy nad yw’n uwch na lefel 1 ar y raddfa safonol ar gyfer pob diwrnod y mae’r methiant yn parhau.

(12)Yn yr adran hon, ystyr “cyfnod cadarnhau” yw’r 3 mis olaf o—

(a)y cyfnod o 5 mlynedd sy’n dechrau â’r dyddiad cofrestru a roddir yn yr hysbysiad sy’n ofynnol gan adran 20(5), a

(b)pob cyfnod dilynol o 5 mlynedd.
