(1)Mae’r adran hon yn gymwys pan fo—
(a)arolygiad neu weithgaredd monitro arall yn cael ei gynnal o dan Bennod 1, neu
(b)asesiad rhagarweiniol neu asesiad llawn yn cael ei gynnal o dan Bennod 2.
(2)Os, o ganlyniad i gynnal yr arolygiad, y gweithgaredd neu’r asesiad—
(a)difrodir unrhyw dir neu eiddo arall, neu
(b)aflonyddir ar fwynhad unrhyw berson o unrhyw dir,
mae gan y personau y cyfeirir atynt yn is-adran (3) hawlogaeth i adennill digollediad oddi wrth yr Awdurdod mewn cysylltiad â’r difrod neu’r aflonyddu.
(3)Y personau yw—
(a)yn achos difrod i dir, unrhyw berson a chanddo ystad neu fuddiant yn y tir;
(b)yn achos difrod i eiddo arall, perchennog yr eiddo;
(c)mewn achos o aflonyddu ar fwynhad person o dir, y person yr aflonyddir ar ei fwynhad o’r tir.
(4)Mae unrhyw anghydfod sy’n codi ynghylch hawliad am ddigollediad o dan yr adran hon i’w benderfynu gan y llys.
(5)Mae Atodlen 2 yn cael effaith mewn perthynas â hawliadau penodol am ddigollediad o dan yr adran hon.
