Labelu, selio a phecynnu deunyddiau planhigion ardystiedig

10.—(1) Rhaid i ddeunyddiau planhigion ardystiedig, a gaiff eu marchnata, gael eu labelu, eu selio a’u pecynnu yn unol â’r rheoliad hwn.

(2) Rhaid i Weinidogion Cymru ddyroddi neu gymeradwyo label (label swyddogol) os yw’r label hwnnw yn bodloni gofynion Rhan 1 o Atodlen 2.

(3) Ond nid oes angen i label a ddefnyddir wrth gyflenwi deunyddiau planhigion ardystiedig i’w manwerthu i ddefnyddiwr olaf nad yw’n broffesiynolyn, ond gynnwys gwybodaeth briodol am y cynnyrch, gan gynnwys enw’r awdurdod cyfrifol, enw neu rif cofrestru’r cyflenwr, yr enw botanegol ac enw’r amrywogaeth.

(4) Rhaid i label swyddogol fod ynghlwm wrth y deunyddiau planhigion ardystiedig.

(5) Pan fo deunyddiau planhigion ardystiedig yn rhan o’r un lot ac yn cael eu marchnata mewn pecyn, bwndel neu gynhwysydd, rhaid rhoi label swyddogol ynghlwm wrth y pecyn, y bwndel neu’r cynhwysydd hwnnw.

(6) Nid yw paragraffau (4) a (5) yn gymwys pan fo pasbort planhigion a ddyroddir yn unol â Chyfarwyddeb 2000/29/EC, sy’n cynnwys yr wybodaeth ym mharagraff 4 o Atodlen 2, yn mynd gyda deunyddiau planhigion ardystiedig.

(7) Ni chaiff cyflenwr farchnata deunyddiau planhigion ardystiedig mewn lotiau o ddau neu ragor o blanhigion neu rannau o blanhigion oni bai bod y lotiau hynny yn ddigon cydryw ac wedi eu pecynnu’n briodol.

(8) At ddibenion paragraff (7), ystyr “wedi eu pecynnu’n briodol” yw bod y planhigion neu’r rhannau o blanhigion—

(a)mewn pecyn neu gynhwysydd sydd wedi ei selio mewn modd sy’n atal y pecyn neu’r cynhwysydd rhag cael ei agor heb ddifrodi’r caead neu wneud y label swyddogol yn annilys; neu

(b)yn rhan o fwndel sydd wedi ei glymu yn y fath fodd fel na ellir gwahanu’r planhigion neu’r rhannau o blanhigion sy’n rhan o’r bwndel heb ddifrodi’r cwlwm neu’r clymau.
