Tystiolaeth mewn achosion gorchmynion interim
32.—(1) Nid yw tystiolaeth yn dderbyniol mewn achosion gorchmynion interim oni bai—
(a)y byddai’n dderbyniol mewn achosion sifil yng Nghymru a Lloegr, neu
(b)bod y panel gorchmynion interim yn ystyried bod y dystiolaeth yn berthnasol, a’i bod yn deg derbyn y dystiolaeth honno.
(2) Mae tystysgrif sydd wedi ei llofnodi gan swyddog cymwys mewn llys o unrhyw awdurdodaeth bod person wedi ei euogfarnu o drosedd neu, yn yr Alban, euogfarn gryno, yn dystiolaeth bendant o’r drosedd.
(3) Mae tystysgrif bod person wedi ei gynnwys ar restr wahardd (at ddibenion adran 117(1)(c) o’r Ddeddf), a ddyroddir gan y person sy’n gyfrifol am gynnal y rhestr, yn dystiolaeth bendant o’r ffaith honno.
(4) Mae tystysgrif a ddyroddir gan gorff perthnasol (at ddibenion adran 117(1)(d) o’r Ddeddf) ei fod wedi dyfarnu bod amhariad ar addasrwydd person i ymarfer yn dystiolaeth bendant o’r dyfarniad hwnnw.
