The Welsh Ministers, in exercise of the powers conferred by sections 23ZA(1)(b), (3) and (4), 104(4) and 104A of the Children Act 1989(1), make the following Regulations.

1989 c. 41; section 23ZA was inserted by section 15 of the Children and Young Persons Act 2008 (c. 23) (“the 2008 Act”); section 104(4) was amended by sections 39 and 42 of the 2008 Act; section 104A was inserted by section 39 of and paragraphs 1 and 26 of Schedule 3 to, the 2008 Act. The powers are expressed to be exercisable by the “appropriate national authority”, defined in section 30A of the Children Act 1989 (“the 1989 Act”) as meaning, in relation to Wales, the Welsh Ministers. For the definition of prescribed see section 105(1) of the 1989 Act.
