Penderfynu man preswylio arferol
5.—(1) Pan fo, at ddibenion Rhan 3 (asesiadau ar ddefnyddwyr blaenorol o wasanaethau iechyd meddwl eilaidd) o'r Mesur, unrhyw amheuaeth p'un ai os yw man preswylio arferol yr oedolyn yn dod o fewn ardal awdurdod lleol (“ardal awdurdod lleol A”), yna mae'r awdurdod lleol ar gyfer ardal awdurdod lleol A (“awdurdod lleol A”) yn gyfrifol am benderfynu o fewn pa ardal awdurdod lleol y mae'r oedolyn hwnnw fel arfer yn preswylio, yn unol â pharagraff (2).
(2) At ddibenion gwneud penderfyniad fel a ddarperir ym mharagraff (1)—
(a)tybir bod oedolyn fel arfer yn preswylio yn y cyfeiriad a roddwyd i awdurdod lleol A gan yr oedolyn hwnnw fel y cyfeiriad y mae fel arfer yn preswylio ynddo;
(b)os na roddir y fath gyfeiriad gan oedolyn tybir bod yr oedolyn hwnnw fel arfer yn preswylio yn y cyfeiriad a roddwyd ganddo i awdurdod lleol A fel y cyfeiriad mwyaf diweddar ar ei gyfer;
(c)pan na ellir penderfynu man preswylio arferol oedolyn o dan is-baragraffau (a) neu (b) uchod, tybir bod yr oedolyn hwnnw fel arfer yn preswylio yn yr ardal lle y mae'n bresennol.
(3) Hyd nes y gwneir penderfyniad ar fan preswylio arferol oedolyn o dan baragraff (1), tybir bod yr oedolyn hwnnw fel arfer yn preswylio o fewn ardal awdurdod lleol A.
(4) Ond pan fo'r partneriaid iechyd meddwl lleol ar gyfer ardal awdurdod lleol arall (“ardal awdurdod lleol B”) yn cytuno i weithredu fel y partneriaid iechyd meddwl lleol ar ran oedolyn, yna tybir bod yr oedolyn hwnnw fel arfer yn preswylio o fewn ardal awdurdod lleol B.
