Nodyn Esboniadol
(Nid yw'r nodyn hwn yn rhan o'r Rheoliadau)
1. Mae'r Rheoliadau hyn yn cynnwys darpariaethau ynghylch asesiadau iechyd meddwl ar gyfer defnyddwyr blaenorol o wasanaethau iechyd meddwl eilaidd.
2. Mae rheoliad 3 yn darparu bod y cyfnod rhyddhau perthnasol a bennir i oedolyn fod yn gymwys am asesiad iechyd meddwl yn dilyn ei ryddhau o wasanaethau iechyd meddwl eilaidd yn dair blynedd. Os rhyddheir yr oedolyn o wasanaethau iechyd meddwl eilaidd cyn y dyddiad y daw'r Rheoliadau hyn i rym, bydd unrhyw gyfnod rhyddhau perthnasol a bennir i'r oedolyn hwnnw fel a ddarperir yn rheoliad 6.
3. Mae rheoliad 4 yn darparu bod copi o adroddiad o'r asesiad yn cael ei ddarparu heb fod yn hwyrach na deng niwrnod gwaith wedi i asesiad iechyd meddwl yr oedolyn gael ei gwblhau.
4. Mae rheoliad 5 yn darparu ar gyfer penderfynu man preswylio arferol yr oedolyn at ddibenion Rhan 3 (asesiadau ar ddefnyddwyr blaenorol o wasanaethau iechyd meddwl eilaidd) o Fesur Iechyd Meddwl (Cymru) 2010, os oes unrhyw amheuaeth ynghylch a yw man preswylio arferol oedolyn wedi ei leoli o fewn ardal awdurdod lleol penodol.
5. Mae rheoliad 6 yn gwneud darpariaeth drosiannol mewn perthynas â'r cyfnod rhyddhau perthnasol ar gyfer oedolyn sydd wedi cael ei ryddhau o wasanaethau iechyd meddwl eilaidd o fewn dwy flynedd cyn y dyddiad y daw'r Rheoliadau hyn i rym.
6. Mae asesiad effaith rheoleiddiol wedi ei baratoi o gostau a buddiannau tebygol cydymffurfio â'r Rheoliadau hyn. Gellir cael copi gan: Y Tîm Deddfwriaeth Iechyd Meddwl, Yr Adran Iechyd, Gwasanaethau Cymdeithasol a Phlant, Llywodraeth Cymru, Parc Cathays, Caerdydd, CF10 3NQ.
