Marchnata tatws hadyd

4.—(1) Rhaid i berson beidio â marchnata unrhyw datws hadyd ac eithrio—

(a)tatws hadyd cyn-sylfaenol;

(b)tatws hadyd sylfaenol;

(c)tatws hadyd ardystiedig;

(ch)tatws hadyd gwyddonol a rhai i'w dethol; neu

(d)tatws hadyd i'w profi a'u treialu.

(2) Rhaid i berson beidio â marchnata unrhyw datws hadyd a gafodd eu trin â chynnyrch a gynhyrchir yn bennaf fel eli i lesteirio eginiad.

(3) Yn y rheoliad hwn, ystyr “tatws hadyd gwyddonol a rhai i'w dethol” (“scientific and selection seed potatoes”) yw tatws hadyd—

(a)o ran tatws hadyd a gynhyrchir yng Nghymru, sydd yn datws hadyd yr awdurdododd y Cynulliad Cenedlaethol eu marchnata yn unol â rheoliad 7; a

(b)o ran tatws hadyd a gynhyrchir y tu allan i Gymru, sydd yn datws hadyd yr awdurdododd yr Awdurdod Ardystio yn y wlad neu'r diriogaeth lle cynhyrchwyd y tatws eu marchnata yn unol ag Erthygl 6(1)(a) o'r Gyfarwyddeb.
