Cynnal yr achos a thystion
19.—(1) Yn ddarostyngedig i is-baragraff (2), pan wneir cais gan unrhyw barti yn y broses gymrodeddu, caiff barnwr y llys sirol, os gwêl yn dda, roi gorchymyn o dan ei l(l)aw i ddwyn gerbron y cymrodeddwr unrhyw berson (yn y cyfeirir ato yn y paragraff hwn fel “y carcharor”) sydd mewn caethiwed mewn unrhyw le o dan unrhyw ddedfryd neu sy'n cael ei draddodi/thraddodi i sefyll ei brawf/phrawf neu fel arall, er mwyn iddo neu iddi gael ei groesholi/chroesholi fel tyst yn y broses gymrodeddu.
(2) Ni chaniateir gwneud unrhyw gyfryw orchymyn o ran person mewn caethiwed dan orchymyn unrhyw achos neu fater sifil.
(3) Yn ddarostyngedig i is-baragraff (4), mae'n rhaid dwyn y carcharor mewn unrhyw gyfryw orchymyn gerbron y cymrodeddwr o dan yr un warchodaeth, ac ymdrin ag ef neu â hi yn yr un modd ym mhob ffordd, fel carcharor y mae'n ofynnol iddo neu iddi o dan writ habeas corpus gael ei d(d)wyn gerbron yr Uchel Lys a'i groesholi/chroesholi yno fel tyst.
(4) Nid yw'r person sy'n gwarchod y carcharor yn gorfod ufuddhau i'r gorchymyn oni chynigir iddo neu iddi swm rhesymol am gludo a chynnal swyddog neu swyddogion priodol a'r carcharor wrth fynd i'r man lle cynhelir y broses gymrodeddu, aros yno, a dychwelyd oddi yno.
