Penodi llywodraethwyr newydd neu eu hethol

45.—(1) Mae'r paragraffau canlynol yn gymwys mewn perthynas â phenodi neu ethol y llywodraethwyr y mae eu hangen i gyfansoddi'r corff llywodraethu yn unol â rheoliad 43(4).

(2) Rhaid i unrhyw riant-lywodraethwr gael naill ai—

(a)ei ethol (ar ôl dyddiad agor yr ysgol) gan rieni'r disgyblion cofrestredig yn yr ysgol newydd a rhaid iddo yntau fod yn rhiant o'r fath ar yr adeg y caiff ei ethol; neu

(b)ei benodi (ar ôl dyddiad agor yr ysgol) yn unol ag Atodlen 1 i'r Rheoliadau Llywodraethu.

(3) Ar ôl dyddiad agor yr ysgol—

(a)rhaid i unrhyw staff-lywodraethwr neu athro-lywodraethwr gael ei ethol yn unol â rheoliadau 5 a 6 o'r Rheoliadau Llywodraethu ac Atodlen 2 iddynt;

(b)rhaid i unrhyw lywodraethwr partneriaeth fod yn berson sydd wedi'i enwebu ac wedi'i benodi yn unol â rheoliad 10 o'r Rheoliadau Llywodraethu ac Atodlen 3 iddynt

(c)rhaid i unrhyw lywodraethwr cymunedol neu lywodraethwr cymunedol ychwanegol gael ei ethol yn unol â rheoliadau 8 a 20 o'r Rheoliadau Llywodraethu.

(4) Os—

(a)yw offeryn llywodraethu ysgol newydd yn darparu ar gyfer penodi un neu ragor o'r llywodraethwyr gan bersonau sy'n gweithredu ar y cyd, a

(b)os yw'r personau hynny'n methu â chytuno ar benodiad,

rhaid i'r penodiad gael ei wneud gan Gynulliad Cenedlaethol Cymru neu'n unol â chyfarwyddyd a roddir gan y Cynulliad Cenedlaethol hwnnw.
