RHAN 2Gofynion Cyffredinol ar gyfer Deunyddiau ac Eitemau

Gorfodi Rheoliad 1935/2004

4.  Yn ddarostyngedig i ddarpariaethau Erthygl 27 (trefniadau trosiannol), bydd unrhyw berson sy'n mynd yn groes i unrhyw un o ddarpariaethau canlynol Rheoliad 1935/2004 yn euog o dramgwydd —

(a)Erthygl 3 (gofynion cyffredinol);

(b)Erthygl 4 (gofynion penodedig ar gyfer deunyddiau ac eitemau adweithiol a deallus);

(c)Erthygl 11(4) a (5) (darpariaethau sy'n ymwneud ag awdurdodiad y Gymuned);

(ch)Erthygl 15(1), (2), (3), (4), (7) ac (8) (labelu);

(d)Erthygl 16(1) (datganiad o gydymffurfio);

(dd)ar neu ar ôl 27 Hydref 2006, Erthygl 17(2) (gallu olrhain).

Awdurdodau cymwys at ddibenion Rheoliad 1935/2004

5.  Dynodir y cyrff canlynol fel awdurdodau cymwys at ddibenion darpariaethau Rheoliad 1935/2004 fel a bennir isod —

(a)o ran Eitemau 9 a 13, yr Asiantaeth;

(b)o ran Eitemau 16(1) a 17(2), yr Asiantaeth a'r awdurdod sy'n gyfrifol am orfodi yn unol â rheoliad 12(1).
