Nodyn Esboniadol

(Nid yw'r nodyn hwn yn rhan o'r Gorchymyn)

Mae'r Gorchymyn hwn yn dirymu ac yn cymryd lle Gorchymyn Crynoadau Anifeiliaid (Mesurau Dros Dro) (Cymru) 2002.

Nid yw'n gymwys yn yr amgylchiadau a nodir yn erthygl 3 (anifeiliaid a grynhoir ar safle y mae eu perchennog yn berchen arno).

Rhaid wrth drwydded ar gyfer crynoadau anifeiliaid (erthygl 4).

Mae'n pennu na chaiff crynhoad anifeiliaid ddigwydd ond ar ôl i 27 o ddiwrnodau fynd heibio ar ôl i'r olaf o'r anifeiliaid adael y safle hwnnw ac i'r cyfarpar ar y safle gael ei lanhau fel nad oes arno arwyddion gweledol ei fod wedi ei halogi (erthygl 5). Os ar safle wedi'i balmantu y crynhoir yr anifeiliaid mae erthygl 6 yn gwneud darpariaeth ar gyfer glanhau a diheintio'r safle hwnnw ac yn ei gwneud yn bosibl i grynhoad ddigwydd o fewn y terfyn amser arferol.

Mae'n gosod dyletswyddau ar y personau sy'n bresennol mewn crynhoad anifeiliaid (erthygl 7 a'r Atodlen).

Mae'n gosod cyfyngiadau yn sgil crynhoad anifeiliaid (erthygl 8).

Mae'n datgymhwyso dros dro ac yn cymryd lle Gorchymyn Marchnadoedd, Gwerthiannau a Llociau 1925 (OS 1925/1349) (erthygl 9).

Fe'i gorfodir gan yr awdurdod lleol neu'r Ysgrifennydd Gwladol (erthygl 10).

Mae peidio ag ufuddhau i'r Gorchymyn yn dramgwydd o dan adran 73 o'r Ddeddf Iechyd Anifeiliaid, ac mae'r gosb am hynny yn unol ag adran 75 o'r Ddeddf honno.

Bydd effaith y Gorchymyn hwn yr dod i ben ar 1 Awst 2003.

Nid oes arfarniad rheoliadol wedi'i baratoi ar gyfer y Gorchymyn hwn.
