Methiant partïon i fod yn bresennol mewn gwrandawiad

17.—(1) Os bydd person a gyhuddwyd yn methu â bod yn bresennol neu â chael ei gynrychioli mewn gwrandawiad y mae wedi'i hysbysu'n briodol amdano, caiff y tribiwnlys—

(a)oni bai ei fod wedi'i fodloni bod rheswm digonol dros yr absenoldeb hwnnw, wrando a phenderfynu ar y dyfarniad yn absenoldeb y person hwnnw; neu

(b)torri'r gwrandawiad;

a chaiff wneud unrhyw orchymyn ynghylch costau a threuliau a wêl yn dda.

(2) Cyn penderfynu y dylid penderfynu ar ddyfarniad yn absenoldeb person a gyhuddwyd, rhaid i'r tribiwnlys ystyried unrhyw sylwadau ysgrifenedig a gyflwynwyd gan y person hwnnw mewn ymateb i'r hysbysiad am y gwrandawiad ac, at ddibenion y paragraff hwn, rhaid trin unrhyw ateb fel sylw ysgrifenedig.
