Subject to the exception below, every county and county borough council in Wales (“local authority”) is required by section 25 of the Local Government Act 2000 (“the Act”) to draw up proposals for the operation of executive arrangements as defined by section 10(1) of the Act.
The exception is where section 31 of the Act applies to the local authority and it decides to draw up proposals for the operation of alternative arrangements under section 31(4)(a) of the Act.
In drawing up proposals under section 25 of the Act, a local authority must decide what form their executive is to take. Their proposals must include such details of the executive arrangements as the National Assembly for Wales may direct, a timetable with respect to the implementation of their proposals and details of any transitional arrangements which are necessary for the implementation of the proposals.
A copy of the proposals must be sent to the National Assembly for Wales and be accompanied by a statement describing the steps taken by the local authority to consult the local government electors for, and other interested persons in, their area. The statement must also describe the outcome of the consultation and the extent to which that outcome is reflected in the proposals.
This Order specifies the date by which a local authority must comply with the requirements of section 25 of the Act. That date is 31 January 2002.
