Olrhain cychod pysgota â lloeren
3.—(1) Yn ddarostyngedig i baragraff (2) mae'r erthygl hon yn gymwys i unrhyw gwch pysgota o fewn y môr tiriogaethol cyfagos at Gymru sy'n mesur mwy nag 20 metr rhwng y sythlinau neu fwy na chyfanswm o 24 metr o hyd.
(2) Nid yw'r erthygl hon yn gymwys i gwch pysgota o'r fath sydd –
(a)yn gweithredu'n llwyr o fewn 12 milltir fôr i'r gwaelodlinau y caiff môr tiriogaethol Aelod-wladwriaeth ei faner ei fesur ohonynt, neu
(b)nad yw byth yn treulio mwy na 24 awr ar y môr, o'i gymryd o'r amser ymadael hyd at amser dychwelyd i'r porthladd.
(3) Rhaid i ddyfais olrhain loerennol –
(a)cael ei gosod;
(b)cael ei chadw yn hollol weithredol,
ar gwch pysgota y mae'r erthygl hon yn gymwys iddo.
(4) Rhaid i'r ddyfais olrhain loerennol honno drosglwyddo'r wybodaeth a fynnwyd –
(a)pan yw'r ddyfais olrhain loerennol yn gallu cael ei pholio:
(i)o leiaf bob dwy awr; neu
(ii)mewn achos y pennir cyfnod hiraf gwahanol ar ei gyfer yn Atodiad I i Reoliad 1489/97, yn ôl y cyfnod hwnnw neu o fewn y cyfnodau hynny; neu
(b)pan nad yw'r ddyfais olrhain loerennol yn gallu cael ei pholio, bob awr, a hynny i Ganolfan Monitro Pysgodfeydd yn y fformat a ragnodir gan Atodiad II i Reoliad 1489/97.
