The Secretary of State for Education makes the following Order in exercise of the powers conferred by sections 16(1)(a), 21(1) and 28 of the Further and Higher Education Act 1992(1).

Citation, commencement, extent and application

1.  This Order may be cited as the National College for Advanced Transport and Infrastructure (Designated Institution in Further Education and Revocations) Order 2021 and comes into force 30th April 2021.

2.  This Order extends to England and Wales but applies in relation to England only.

Designation

3.  The National College for Advanced Transport and Infrastructure(2), being an educational institution of the kind described in subsections (1)(b) and (2)(d) of section 28 of the Further and Higher Education Act 1992, is designated as an institution for the purposes of that section.

Revocations

4.  The National College for High Speed Rail (Incorporation) Order 2015(3) and the National College for High Speed Rail (Government) Regulations 2015(4) are revoked.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order designates the institution of the National College for Advanced Transport and Infrastructure for the purposes of section 28 of the Further and Higher Education Act 1992 (“the Act”). This designation is made in the context of the merger of an existing further education college into the group structure of the University of Birmingham, with the designated institution being a subsidiary of the University. This designation takes effect on 30th April 2021 and designates the institution as an institution within the further education sector as defined in section 91(3) of the Act.

This Order revokes (i) the Order incorporating the National College for High Speed Rail as a further education corporation for the purposes of section 16(1)(a) of the Act and (ii) Regulations which prescribe the instrument of government and articles of government of that further education corporation for the purposes of section 21(1) of the Act.

An impact assessment has not been produced for this instrument as it has no impact on businesses and civil society organisations. The instrument has no impact on the public sector.

1992 c. 13. Section 21(1) was amended by section 140(1) and (3) to, and Schedule 30, paragraph 35(a) and Schedule 31 to, the School Standards and Framework Act 1998 (c. 31) (“the 1998 Act”). Section 28(1) was amended by section 143(1)(a) of the Learning and Skills Act 2000 (c. 21) (“the 2000 Act”). Section 28(2)(a) was amended by section 140(1) of, and Schedule 30, paragraph 38 to, the 1998 Act. Section 28(2)(b) was repealed by section 143(1)(b), section 153 and Schedule 11 of the 2000 Act. Section 28(2)(d) was inserted by section 143(1)(c) of the 2000 Act.
