26.—(1) The Marketing of Ornamental Plant Propagating Material Regulations 1999(1) are amended as follows.
(2) In regulation 2(1)—
(a)omit the definition of “Directive 77/93/EEC”;
(b)in the definition of “Directive 98/56/EC”, at the end insert “, as last amended by Regulation (EU) No 652/2014 of the European Parliament and of the Council(2)”;
(c)after the definition of “Directive 98/56/EC” insert—
““Directive 2000/29/EC” means Council Directive 2000/29/EC on protective measures against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community(3);”.
(3) In regulation 7(4), for “regulation 15 of the Plant Health (Great Britain) Order 1993(4)” substitute “article 25 of the Plant Health (England) Order 2015(5)”.
(4) In regulation 8(3)—
(a)for the words from “plant pest” to “1993” substitute “notifiable plant pest as defined in article 42(3) of the Plant Health (England) Order 2015”;
(b)for “article 20” substitute “article 42”.
(5) In regulation 9(2), for “Council Directive 77/93/EEC” substitute “Directive 2000/29/EC”.
(6) In regulation 12(3), for the words from “article 12(5)” to the end substitute “article 9(1) of the Plant Health (England) Order 2015”.
