Her Majesty, in pursuance of section 22 of, and paragraph 4(1)(c) of Schedule 3 to, the Charities Act 2011(1), is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:
1. This Order may be cited as the Exempt Charities Order 2016 and shall come into force on 13th April 2016.
2. The British School of Osteopathy is hereby declared to be an exempt charity for the purposes of the Charities Act 2011.
3. The Exempt Charities (No. 2) Order 2015(2) is hereby revoked.

This Order declares The British School of Osteopathy to be an exempt charity for the purposes of the Charities Act 2011 under paragraph 4(1)(c) of Schedule 3 to the Act with effect from 13th April 2016. An exempt charity cannot be registered with the Charity Commission and the Commission cannot exercise any powers under the Act in relation to an exempt charity except:
it may exercise advisory and permissive powers at the charity’s request, following consultation with any principal regulator appointed under the Charities Act 2011;
ii) it may open a statutory inquiry and use powers to act for the protection of charities at the invitation of any principal regulator appointed under the Charities Act.
The Higher Education Funding Council for England (HEFCE) has been appointed principal regulator for exempt universities and Higher Education Institutions in England, and automatically becomes principal regulator for The British School of Osteopathy.
This Order replaces the Exempt Charities (No. 2) Order 2015 and corrects an error in that Order, which purported to declare The British School of Osteopathy to be an exempt charity under paragraph 4(1)(a) of the Charities Act 2011. The Exempt Charities (No. 2) Order 2015 is revoked by this Order.
