Amendment of the Registration of Births, Deaths and Marriages (Fees) Order 2010

2.  For the Schedule to the Registration of Births, Deaths and Marriages (Fees) Order 2010(1) substitute—

Section 10 was amended by section 94 of, and Part III of Schedule 6 to, the Post Office Act 1969 (c. 48), and by section 4(3) and 7(3) of, and Schedule 4 to, the Trustee Savings Banks Act 1985 (c.58). Section 43A was inserted by section 4 of, and paragraphs 1 and 2 of Schedule 1 to, the Marriage (Same Sex Couples) Act 2013 (c. 30). For the fee payable where an application is made in respect of a building that is already registered under section 43A, see regulation 9(e) of the Marriage of Same Sex Couples (Registration of Buildings and Appointment of Authorised Persons) Regulations 2014 (S.I. 2014/106), which modifies the fee payable under section 41(6) of the Marriage Act 1949. If an application is made for registration under both section 41 and section 43A of the Marriage Act 1949 at the same time, regulation 10(2)(b) of S.I. 2014/106 provides that no fee is payable under section 43A, but the fee for a previously unregistered building under section 41(6) applies.
