9.—(1) A local authority may not make direct payments in respect of any goods or services which are to be used or provided in a school(1) or post-16 institution without the written consent of the head teacher, principal or the person occupying an equivalent position.
(2) A local authority may not make direct payments in respect of any goods or services which are to be used or provided on premises where relevant early years education is provided without the written consent of the provider of the relevant early years education.
School is defined in section 4 of the Education Act 1996 c.56 which is applied by section 83(7) of the 2014 Act.
