4.—(1) After regulation 5 of the 2012 Regulations insert—
5A. Regulation 3 shall not apply where the local planning authority to whom the application is made are satisfied that the application relates solely to development which is relevant demolition (within the meaning of section 196D of the 1990 Act(1)).”
Section 196D was inserted into the 1990 Act by paragraph 6 of Schedule 17 to the Enterprise and Regulatory Reform Act 2013 (c. 24).
