This Order brings into force on 8th October 2012 the provisions of the Police and Justice Act 2006 (c. 48) (“the 2006 Act”) specified in Article 2 in so far as they are not already in force.
Section 45 of the 2006 Act inserts section 57C of the Crime and Disorder Act 1998 (c. 37). Section 57C of the Crime and Disorder Act 1998 enables the use of a live video link at a preliminary hearing in a magistrates’ court where the accused is in police detention at a police station.
Section 46 of the 2006 Act amends the Police and Criminal Evidence Act 1984 (c. 60) to enable the police to grant bail subject to a duty to attend at a police station for proceedings in relation to a live link direction.
