The Secretary of State for Business, Innovation and Skills makes the following Order in exercise of the powers conferred by section 122A of the Education Reform Act 1988(1).

In accordance with section 122A(1), it appears to the Secretary of State that the full-time equivalent enrolment number of the institution conducted by Leeds College of Art(2) for courses of higher education exceeds 55 per cent of its total full-time equivalent enrolment number.

1.  This Order may be cited as the Leeds College of Art (Transfer to the Higher Education Sector) Order 2011 and comes into force on 1st August 2011.

2.  On 1st August 2011 Leeds College of Art is transferred to the higher education sector.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order makes provision for the transfer of Leeds College of Music from the further education sector to the higher education sector on 1st August 2011.

An impact assessment has not been prepared for this instrument because it has no impact on the cost of business.

1988 c40: section 122A was inserted by section 74 of the Further and Higher Education Act 1992. By virtue of S.I. 1999/672 the power in section 122A is exercisable by the Secretary of State only in relation to England.

Incorporated under section 15 of the Further and Higher Education Act 1992 (c.13) by S.I. 1992/2097 under the name of Jacob Kramer College, Leeds. It changed its name to Leeds College of Art and Design on 22nd February 1993 and then to Leeds College of Art on 6th January 2009.
