The Secretary of State for Work and Pensions, in exercise of the powers conferred by sections 22(5), 23A(4), 122(1) and 175(1) and (3) to (5) of the Social Security Contributions and Benefits Act 1992(1), makes the following Regulations.

In accordance with section 173(1)(b) of the Social Security Administration Act 1992(2), the Secretary of State has obtained the agreement of the Social Security Advisory Committee that proposals in respect of these Regulations should not be referred to it.

1992 c. 4. Section 22(5) was amended by paragraph 22 of Schedule 2 to the Jobseekers Act 1995 (c. 18) and paragraph 9(3)(b) of Schedule 3 to the Welfare Reform Act 2007 (c. 53). Section 23A was inserted by section 3(1) of the Pensions Act 2007 (c. 22). Section 122(1) is an interpretation provision and is cited as it defines “prescribe”. Section 175 was amended by paragraph 36 of Schedule 1 to the Social Security (Incapacity for Work) Act 1994 (c. 18) and paragraph 29 of Schedule 3 to the Social Security Contributions (Transfer of Functions, etc.) Act 1999 (c. 2).
