The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 12 of the Highways Act 1980(1) and now vested in her(2)—

1.  This Order may be cited as the A435 Trunk Road (Warwickshire and Worcestershire) (Detrunking) Order 2007 and shall come into force on 28th January 2008.

2.  In this Order—

(i) all measurements of distance are measured along the route of the relevant highway;

(ii) “the plan” means the folio numbered HA/10/TD/025 consisting of 1 sheet marked “The A435 Trunk Road (Warwickshire and Worcestershire) (Detrunking) Order 2007 signed by the authority of the Secretary of State for Transport and deposited at the ODPM–DfT Records Management Branch, Ashdown House, St Leonards on Sea, Hastings, East Sussex, TN37 7GA;

(iii) “principal road” as a classification for a highway, means that the highway is a principal road for the purposes of enactments and instruments which refer to highways classified as principal roads and is also classified for the purpose of every other enactment and instrument which refers to highways classified by the Secretary of State; and

(iv) “the trunk road” means the Birmingham to Alcester Trunk Road (A435).

3.  The length of the trunk road described in the Schedule to this Order shall cease to be a trunk road and shall be classified as a principal road from the date on which the Order comes into force.

SCHEDULE LENGTH OF THE TRUNK ROAD CEASING TO BE A TRUNK ROAD

The lengths of the A435 trunk road ceasing to be a trunk road are situated:

(i) between the roundabout with the A46 (marked “C” on the plan) and the boundary of the Counties of Warwickshire and Worcestershire approximately 80m northwest of the property known as Gorcott Hall (marked “B” on the plan), a distance of approximately 13 kilometres.

(ii) between the boundary of Counties of Warwickshire and Worcestershire (marked “B” on the plan) and the roundabout junction with the M42 Motorway, excluding the circulatory carriageway of that roundabout (marked “A” on the plan), a distance of approximately 5 kilometres.

The two lengths are shown by broad black dashes on the plan numbered HA 10/TD/025 marked “The A435 Trunk Road (Warwickshire and Worcestershire) (Detrunking) Order 2007” signed by authority of the Secretary of State for Transport, ODPM–DfT Records Management Branch, Floor 13 (IMD), Ashdown House, St Leonards on Sea, Hastings, East Sussex TN37 7GA.
