This Order amends the Road Traffic (Permitted Parking Area and Special Parking Area) (County of Hertfordshire) (Borough of Watford) Order 1997 (“the Principal Order”). The Principal Order designated the Borough of Watford with the exception of certain lengths of trunk road (“the designated area”) as a permitted parking area and a special parking area.
This Order amends Schedule 2 of the Principal Order by removing Part II, which provided that paragraphs 1(4)(ab) and 2(4)(bb) of Schedule 3 (“the Schedule”) to the Road Traffic Act 1991 would not apply in relation to the designated area.
Paragraph 1(4)(ab) provides that it is not an offence to contravene an order made under section 35 of the Road Traffic Regulation Act 1984 (c.27) (“the 1984 Act”) (use of parking places provided under s32 or 33) in the designated area. Paragraph 2(4)(bb) provides that it is not an offence to contravene an order made under section 61 of the 1984 Act (prohibition of vehicles in loading areas), so far as it applies to stationary vehicles, in the designated area. Contravention of the provisions of any such order in the designated area will now instead give rise to a penalty charge in accordance with paragraph 3(2) of the Schedule.
