The Minister for the Civil Service in exercise of the powers conferred by sections 1(5), 1(7) and 1(8)(a) and (c) of the Superannuation Act 1972(1) and now vested in him(2) makes the following Order:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Superannuation (Admission to Schedule 1 to the Superannuation Act 1972) Order 2006 and shall come into force on 2nd February 2007, but shall have effect, as appropriate, from the dates specified in this Order.

(2) In this Order—

“the Act” means the Superannuation Act 1972.

Employments

2.—(1) Section 1 of the Act shall apply to the following employments with effect from the dates specified below—

(a)employment by the Commonwealth Parliamentary Association (United Kingdom Branch), with effect from 1st April 2006;

(b)employment by the Trustees of the Independent Living (Extension) Fund and the Independent Living (1993) Fund, with effect from 1st April 2006;

(c)employment by the NHS Business Services Authority (Awdurdod Gwasanaethau Busnes y GIG), with effect from 1st April 2006;

(d)employment by the Adjudicator to Her Majesty’s Land Registry (being employment which is remunerated from the Land Registry Trading Fund established by the Land Registry Trading Fund Order 1993)(3), with effect from 1st June 2005;

(e)employment by the Quality Improvement Agency, with effect from 1st April 2006;

(f)employment by The School Food Trust, with effect from 1st April 2006; and

(g)employment by the Scottish Parliamentary Standards Commissioner, with effect from 1st April 2003.

(2) Accordingly, Schedule 1 to the Act is amended by inserting at the appropriate places, with effect from the relevant dates specified in article 2(1), in the list of “Other Bodies”, the entries—

“Commonwealth Parliamentary Association (United Kingdom Branch)”

“Employment by the Trustees of the Independent Living (Extension) Fund and the Independent Living (1993) Fund”

“NHS Business Services Authority (Awdurdod Gwasanaethau Busnes y GIG)”

“Employment by the Adjudicator to Her Majesty’s Land Registry”

“Quality Improvement Agency”

“The School Food Trust”

“Employment by the Scottish Parliamentary Standards Commissioner”.

Offices

3.—(1) Section 1 of the Act shall apply to the following offices with effect from the dates specified below—

(a)the Chief Electoral Officer for Northern Ireland, with effect from 1st May 2006; and

(b)the Scottish Parliamentary Standards Commissioner, with effect from 1st April 2003.

(2) Accordingly, Schedule 1 to the Act is amended by inserting at the appropriate places, with effect from the relevant dates specified in article 3(1), in the list of “Offices”, the entries—

“the Chief Electoral Officer for Northern Ireland”

“the Scottish Parliamentary Standards Commissioner”.

Removal from Schedule 1

4.  The following entries are removed from the list of “Other Bodies” in Schedule 1 to the Act—

“The Greater London Magistrates’ Courts Authority”, with effect from 31st March 2006;

“NHS Pensions Agency (Asiantaeth Pensiynau’r GIG)”, with effect from 31st March 2006; and

“Wine Standards Board”, with effect from 30th June 2006.

Employment by Her Majesty’s Customs and Excise

5.—(1) Section 1 of the Act shall apply, with effect from the dates specified below, to employment by Her Majesty’s Customs and Excise (now Her Majesty’s Revenue and Customs), as a result of the following recruitment exercises—

(a)PERMSGB2/2000, with effect from 20th April 2000;

(b)NIPERMJB2/2000, with effect from 15th January 2001;

(c)FTAJB4/2001, with effect from 16th September 2002;

(d)MERCJB2/2002, with effect from 3rd March 2002;

(e)MERCJB3/2002, with effect from 6th January 2002;

(f)MERCJB4/2002, with effect from 24th February 2002;

(g)MERCJB6/2002, with effect from 16th December 2002;

(h)EKCAS/2003, with effect from 1st March 2004;

(i)LDCAS/2003, with effect from 24th November 2003;

(j)NIJB2/2004, with effect from 16th August 2004; and

(k)NIJB4/2004, with effect from 20th September 2004.

(2) Accordingly, Schedule 1 to the Act is amended by inserting at the appropriate place, with effect from the relevant dates specified in article 5(1), in the list of “Other Bodies” the entry—

“Employment by Her Majesty’s Customs and Excise (now Her Majesty’s Revenue and Customs) as a result of the following recruitment exercises—

PERMSGB2/2000;

NIPERMJB2/2000;

FTAJB4/2001;

MERCJB2/2002;

MERCJB3/2002;

MERCJB4/2002;

MERCJB6/2002;

EKCAS/2003;

LDCAS/2003;

NIJB2/2004; and

NIJB4/2004”.

(3) The entry in Schedule 1 to the Act inserted by article 5(2) of this Order is removed, with effect from 5th May 2006, from the list of “Other Bodies”.

Amendment

6.  In article 2(2) of the Superannuation (Admission to Schedule 1 of the Superannuation Act 1972) Order 2005, for “NHS Confederation (Employers) Company Limited” substitute “The NHS Confederation (Employers) Company Limited”, with effect from 1st October 2004.

EXPLANATORY NOTE

(This note is not part of the Order)

1.  Section 1 of the Superannuation Act 1972 (the “Act”) permits the Minister for the Civil Service to make schemes which make provision for pensions and other benefits in respect of civil servants and persons serving in an employment or office listed in Schedule 1 to the Act. The Principal Civil Service Pension Scheme, the Civil Service Additional Voluntary Contribution Scheme, the Civil Service Compensation Scheme and the Civil Service Injury Benefits Scheme are schemes which have been made under section 1 of the Act.

2.  This Order adds employment by the Commonwealth Parliamentary Association (United Kingdom Branch), the Trustees of the Independent Living (Extension) Fund and the Independent Living (1993) Fund, the NHS Business Services Authority, the Adjudicator to Her Majesty’s Land Registry, the Quality Improvement Agency, The School Food Trust and the Scottish Parliamentary Standards Commissioner.

3.  This Order also adds the offices of the Chief Electoral Officer for Northern Ireland and the Scottish Parliamentary Standards Commissioner to those listed in Schedule 1 to the Act.

4.  The addition of these employments and offices to Schedule 1 to the Act makes the persons serving in the employments or offices eligible to be members of the schemes made under section 1 of the Act, subject to the rules of those schemes.

5.  Employment by The Greater London Magistrates’ Court Authority, the NHS Pensions Agency (Asianteth Pensiynau’r GIG), and the Wine Standards Board is removed from those listed in Schedule 1 to the Act.

6.  Article 5 has the effect of making persons employed by Her Majesty’s Customs and Excise (now Her Majesty’s Revenue and Customs) and recruited through certain specified recruitment exercises, eligible to be members of the schemes made under section 1 of the Act for a specified period of time.

7.  Article 6 of this Order amends a typographical error contained in the Superannuation (Admission to Schedule 1 to the Superannuation Act 2005) Order.

8.  The changes to Schedule 1 to the Act made by this Order have effect from dates that are before the date this Order is made. This is authorised by section 1(8)(a) of the Act.
