2. The Liverpool Institute for Performing Arts, being an institution which appears to the Secretary of State to fall within section 129(2) of the Education Reform Act 1988, is designated as an institution eligible to receive support from funds administered by the Higher Education Funding Council for England(1).
The reference to a “higher education funding council” in section 129(1) of the Education Reform Act 1988 is to be read as a reference to the Higher Education Funding Council for England in accordance with section 62(6) of the Further and Higher Education Act 1992 (c. 13).
