In exercise of the powers conferred upon me by section 19(5) of the Nurses, Midwives and Health Visitors Act 1997(1), I hereby approve the rules made by the United Kingdom Central Council for Nursing, Midwifery and Health Visiting and set out in the Schedule hereto.

This Order may be cited as the Nurses, Midwives and Health Visitors (Amendment) Rules Approval Order 2002 and shall come into force on 31st March 2002.

SCHEDULETHE NURSES, MIDWIVES AND HEALTH VISITORS (AMENDMENT) RULES 2002

The United Kingdom Central Council for Nursing, Midwifery and Health Visiting, in exercise of the powers conferred on it by sections 2, 7, 8(2), 17(3) and 19(1) of the Nurses, Midwives and Health Visitors Act 1997(2), and of all other powers enabling it in that behalf, and after due consultation in accordance with section 19(3) thereof, hereby makes the following rules—

Citation and interpretation

1.—(1) These rules may be cited as the Nurses, Midwives and Health Visitors (Amendment) Rules 2002.

(2) For the purposes of these rules, “the Rules” means the Nurses, Midwives and Health Visitors Rules 1983(3).

Amendment of the Rules

2.—(1) The Rules shall be amended in accordance with the following paragraphs of this rule.

(2) In rule 2(1), for the definition of “student” there shall be substituted—

“student” means any person undertaking a course of training at an approved educational institution or approved training institution with a view to qualifying for registration as a nurse, midwife or health visitor.

(3) In paragraph 1(B) of rule 6 the words “in any of Parts 1, 8 or 10 of the register” shall be deleted.

(4) After rule 5, there shall be inserted—

5A(1) fees to be paid for admission or readmission to Part or Parts of the register or for renewal of registration shall be those determined by the Council with the approval of the Secretary of State from time to time.

(2) The Council may permit such fees to be paid in annual amounts in accordance with the conditions attaching to such annual payments as the Council shall from time to time determine.

(3) If a person has arranged with the Council to pay her fee by annual amounts and any of those payments is not received by the due date her registration shall lapse.

(4) the Registrar shall, not fewer than 45 days before the due date, send to that person at her registered address, notification of the amount to be paid and the date on which it is due to be paid.

(5) The due date for the purposes of paragraphs (3) and (4) is five working days before the anniversary of—

(a)the first annual payment of the fee concerned where the payment due is the second annual payment; and, in any other case,

(b)the date on which the previous annual payment of the fee concerned was payable.

(5) Rule 6(3) shall be deleted.

(6) In rule 14B, after paragraph (2) there shall be inserted—

(2A) Subject to paragraph (5), where a student holds a degree which, on the recommendation of an approved educational institution or approved training institution is approved by the Council for the purposes of this paragraph, she may undertake a course of not less than 2 years' duration where the student attends full-time or 4 years' duration where she attends part-time, provided that, on successful completion of the course, a student would meet the outcomes and competencies set out in the Schedule attached hereto.

(7) Rule 20 shall be deleted.

(8) In Rule 25, paragraphs (1) and (2)(a) shall be deleted.

(9) Rule 34 shall be deleted.

(10) Rule 35(a) shall be deleted.

Explanatory Note

(This note is not part of the Order)

The Rules approved by this Order, made by the United Kingdom Central Council for Nursing, Midwifery and Health Visiting, further amend the Rules approved by the Nurses, Midwives and Health Visitors Rules Approval Order 1983 (S.I. 1983/873) to provide for the payment of the registration fee by annual amounts; for a shortened period of training for students with approved degrees; and for the removal of the requirement that indexes of students be kept.

1997 c. 24. The Act is repealed by section 60(3) of, and Schedule 5 to, the Health Act 1999 (c. 8) from a date or dates to be appointed.
