The Secretary of State for the Environment, Transport and the Regions, in exercise of the powers conferred by sections 89(7) and (9) and 105(1) and (3) of the Road Traffic Act 1988(1) and after consultation with representative organisations in accordance with section 195(2) of that Act, hereby makes the following Regulations:

Citation and Commencement

1.  These Regulations may be cited as the Motor Vehicles (Driving Licences) (Amendment) (No. 2) Regulations 2001 and shall come into force on 1st February 2001.

Revocation

2.  In regulation 8 of the Motor Vehicles (Driving Licences) (Amendment) Regulations 2001, paragraph (4) (amendment of regulation 43(3) of the Motor Vehicles (Driving Licences) Regulations 1999)(2) is hereby revoked.

Amendment of the Motor Vehicles (Driving Licences) Regulations 1999

3.—(1) Regulation 43 of the Motor Vehicles (Driving Licences) Regulations 1999(3) shall be further amended as follows.

(2) In paragraph (3) for the words preceding “in addition” there shall be substituted “Subject to paragraphs (5) and (6), the licence shall”.

(3) After paragraph (5) there shall be added the following paragraph—

(6) In relation to the first item of Schedule 2 (category A), the effect of paragraph (3) shall be that a licence authorising the driving of vehicles in category A shall in addition authorise the driving of vehicles in category B1, if and only if, the test, or as the case may be the practical test, is passed before 1st February 2001.

Explanatory Note

(This note is not part of the Regulations)

These Regulations make a further amendment to the Motor Vehicles (Driving Licences) Regulations 1999.

Regulation 3(3) adds a new paragraph (6) to regulation 43 of the 1999 Regulations, whereby persons who pass a test of competence to drive vehicles in category A (motor bicycles) will no longer have full entitlement also to drive vehicles in sub-category B1 (3 or 4 wheeled motor vehicles having an unladen weight not exceeding 550 kilograms), unless they passed the test before 1st February 2001. Regulations 2 and 3(2) substitute new amendments to regulation 43(3) in place of those made by the Motor Vehicles (Driving Licences) (Amendment) Regulations 2001.

These Regulations remedy an omission from the Motor Vehicles (Driving Licences) (Amendment) Regulations 2001 which make other amendments to the 1999 Regulations and come into force on 1st February 2001. These Regulations are accordingly being issued free to all known recipients of the Motor Vehicles (Driving Licences) (Amendment) Regulations 2001.
