21.—(1) On the application of a party made by notice to the Secretary or of his own motion, the President or a Regional Chairman may at any time, with the consent of the President of the Employment Tribunals (Scotland), direct any proceedings to be transferred to the Office of the Employment Tribunals (Scotland) if it appears to him that the proceedings could be, and would more conveniently be, determined in an employment tribunal (Scotland) established in pursuance of the Employment Tribunals (Constitution and Rules of Procedure) (Scotland) Regulations 2001(1); but no such direction shall be made unless notice has been sent to all parties concerned giving them an opportunity to show cause why a direction should not be made.
(2) Where proceedings have been transferred to the Office of the Employment Tribunals (England and Wales) under rule 21(1) of the Employment Tribunals Rules of Procedure (Scotland) 2001 they shall be treated as if in all respects they had been commenced by an originating application pursuant to rule 1.
