The Secretary of State for the Environment, Transport and the Regions, in exercise of the powers conferred upon him by sections 67, 69 and 213(2) of the Water Industry Act 1991(1) and, in relation to England, section 77(3) and (4) of that Act(2), and in exercise of all other powers enabling him in that behalf, hereby makes the following Regulations:
1991 c. 56. Section 213 is amended by the Competition and Service (Utilities) Act 1992 (c. 43). Functions under section 67 of the Water Industry Act 1991 for making regulations concerning water supplied by water undertakers, and functions under section 69 of that Act were transferred to the National Assembly for Wales in relation to any water undertaker whose area is wholly or mainly in Wales by the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672), Schedule 1, as substituted by S.I. 2000/253, Schedule 3. Functions under section 213 of the Water Industry Act 1991 are exercisable by the National Assembly for Wales to the same extent as the powers, duties and other provisions to which that section applies are exercisable by the Assembly; see S.I. 1999/672, Schedule 1, as substituted by S.I. 2000/253, Schedule 3.
Functions under section 77(3) and (4) of the Water Industry Act 1991 are transferred to the National Assembly for Wales, so far as exercisable in relation to Wales, by S.I. 1999/672, Schedule 1, as substituted by S.I. 2000/253, Schedule 3.
