Interpretation

2.—(1) In these Regulations—

“BS EN 1810” means the British Standard Specification for the Body piercing post assemblies Reference test method for determination of nickel content by flame atomic absorption spectrometry published by the British Standards Institution on 15th November 1998(1);

“BS EN 1811” means the British Standard Specification for the Reference test method for release of nickel from products intended to come into direct and prolonged contact with the skin published by the British Standards Institution on 15th April 1999(2);

“BS EN 12472” means the British Standard Specification for the test method for the simulation of wear and corrosion for the detection of nickel release from coated items published by the British Standards Institution on 15th April 1999(3);

“supply” includes offering to supply, agreeing to supply, exposing for supply and possessing for supply.

(2) A reference in these Regulations to—

(a)BS EN 1810,

(b)BS EN 1811, or

(c)BS EN 12472

is a reference to that standard as it has effect when these Regulations are made, provided that where that standard is amended or revised after these Regulations are made and the amendment or revision is approved by the Secretary of State, that reference shall be construed at any time after such approval as a reference to that standard as so amended or revised.

(3) The requirements of regulation 3(1), (2) and (4) shall be satisfied if the post assembly or other product conforms to any standard or specification recognised for use in a Member State of the European Community or any other State within the European Economic Area, provided that conformity to such a standard or specification provides a level of safety at least equivalent to that which would be provided by compliance with those requirements, and any reference to those requirements shall be construed accordingly.
