These Regulations replace the provisions of the Education (Individual Performance Information) (Prescribed Bodies and Persons) (Wales) Regulations 1998 (S.I. 1998/1220) which lapsed on 1st April 1999 by virtue of paragraph 153 of Schedule 30 to the School Standards and Framework Act 1998 and article 5 of the School Standards and Framework Act 1998 (Commencement No 3 and Saving and Transitional Provisions) Order 1998 (S.I. 1998/2791).
Section 537A(5)(b) of the Education Act 1996, as substituted by paragraph 153 of Schedule 30 to the School Standards and Framework Act 1998, provides that an information collator may, at such times as the Secretary of State may determine, provide such individual pupil information as may be prescribed to a prescribed person or any person falling within a prescribed category.
“Information collator” and “individual pupil information” are defined in section 537A(9).
These Regulations prescribe the information that may be provided and the persons to whom it may be provided, for the purposes of section 537A(5)(b).
