The Secretary of State for the Environment, Transport and the Regions and the Secretary of State for Wales, acting jointly in exercise of the powers conferred by section 1(5) of the Local Authorities (Goods and Services) Act 1970(1), hereby make the following Order:

Citation and commencement

1.  This Order may be cited as the Local Authorities (Goods and Services) (Public Bodies) (No. 2) Order 1998 and shall come into force on 17th April 1998.

Designation of public body

2.  Further Education (London Region) Services (“FELORS”), being a person appearing to the Secretary of State for the Environment, Transport and the Regions and to the Secretary of State for Wales to be exercising functions of a public nature, shall be a public body for the purposes of the Local Authorities (Goods and Services) Act 1970 in its application to England and Wales.

Restriction on agreements

3.  Agreements which may be entered into by FELORS by virtue of this Order shall be restricted to agreements with a local authority for the provision of administrative, professional or technical services by that authority to FELORS in connection with FELORS’s activities in the field of further and higher education and training.

Explanatory Note

(This note is not part of the Order)

Article 2 of this Order designates Further Education (London Region) Services (“FELORS”) as a public body under section 1(5) of the Local Authorities (Goods and Services) Act 1970.

The effect of designation is to allow a local authority to provide goods and services to the designated bodies. By virtue of Article 3, the provision which an authority may make is restricted to provision of administrative, professional or technical services in connection with FELORS’s activities in the field of further and higher education and training.
